DSPFY Terms of Service
Effective Date: April 9, 2026
The short version
DSPFY is built for direct support professionals by FY Network Inc.. Use it, keep your notes on your phone, don't use it to do anything illegal, don't sue us if it breaks, and understand that DSPFY is a tool — not legal advice, not medical advice, not a replacement for your training. With that said, we built DSPFY to make your work easier. Treat it well and it will treat you well.
1. Who these Terms apply to
These Terms of Service ("Terms") govern your use of the DSPFY mobile application (the "App") and related services, websites, and content, provided by FY Network Inc. ("FY Network," "we," "us," or "our"). By installing or using DSPFY, you agree to these Terms. If you do not agree, do not install or use DSPFY.
2. DSPFY is free for direct support professionals
DSPFY is free for individual direct support professionals and has no paid tiers, subscriptions, or in-app purchases. This is not an introductory offer. It is a core commitment of the product. We may in the future offer paid connected-mode features that an agency pays for; those features are an agency's business and will never result in a charge to you as an individual DSP.
3. What DSPFY is — and is not
DSPFY is a software tool that helps direct support professionals write visit notes, track credentials and trainings, browse state regulatory content, and access educational material about their work. DSPFY is not a substitute for professional training, supervision, legal advice, clinical judgment, emergency services, or the policies and procedures of the agency you work for.
If you are in an emergency, call 911. If you are uncertain about a clinical situation, follow your agency's protocols and contact your supervisor. If you need legal advice, consult a licensed attorney. DSPFY may point you at resources for any of the above, but DSPFY itself is not a professional advisor.
4. You own your data
Anything you enter into DSPFY — visit notes, credentials, client identifiers, personal settings — belongs to you. It is stored on your device, not on our servers. You can export it via the share sheet or full-export flow, delete it with one tap in Settings, or uninstall the app entirely. We do not claim ownership of any content you create in DSPFY, and we will never sell, license, or transfer your content to anyone.
5. How to use DSPFY responsibly
DSPFY is a documentation and knowledge tool for a regulated profession. By using it, you agree to:
- Review and verify every AI-structured note before saving or submitting it. The on-device model is a drafting assistant; it is not infallible. You are the professional. Your judgment is the final authority on what you document.
- Use minimal identifiable information (initials, not full names; no Social Security numbers; no home addresses unless your agency requires it).
- Not use DSPFY to fabricate documentation for services that were not actually provided. Fabricated documentation is Medicaid fraud and carries criminal penalties.
- Comply with your agency's own policies about documentation tools. If your agency prohibits the use of third-party apps for documenting visits, follow your agency's policy. DSPFY is not here to get you in trouble.
- Comply with applicable HIPAA, state privacy, and labor laws. DSPFY helps you comply, but legal responsibility for compliance rests with you and your employer.
- Not attempt to reverse-engineer, decompile, or extract the DSPFY AI model weights for commercial use outside DSPFY itself (see Section 11 on model licensing).
6. Disclaimers about AI-generated content
DSPFY uses a language model to structure visit notes, score documentation against Medicaid requirements, and offer suggestions. Language models are probabilistic. They can and will occasionally produce output that is wrong, incomplete, or misleading. You are responsible for reviewing every AI-generated output before relying on it.
In particular:
- AI-suggested note content is a draft, not a final record.
- AI-generated regulatory summaries are for reference only. When in doubt, consult the original source (linked inside the app for every piece of regulatory content).
- AI-suggested emergency responses are general guidance based on publicly available protocols. In an actual emergency, rely on your training, your agency's protocols, and 911.
- AI is not a substitute for legal counsel, medical advice, clinical judgment, or professional supervision.
If you spot an AI output that is wrong or misleading, please email admin@fynetwork.com. We read every report and use them to improve the model and prompts.
7. Regulatory content is informational, not legal advice
DSPFY bundles and updates a library of New Jersey Division of Developmental Disabilities (NJ DDD) regulations, labor rights content, emergency protocols, and related professional guidance. We curate this content carefully and cite original sources. But the content is informational. It is not legal advice. Regulations change, your situation may differ from the general case, and only a licensed attorney or the relevant regulatory body can give you authoritative guidance specific to your situation.
For legal advice, we recommend contacting Disability Rights New Jersey, the New Jersey Public Defender system, a private attorney, or (if you are a union member) your union's legal referral service. DSPFY can point you at these resources but is not a substitute for them.
8. Advocacy stance
DSPFY is explicitly pro-worker. We take the DSP's side. Content in the app includes guidance on labor rights, wage theft, whistleblower protections, and related advocacy topics. We do not view this as controversial — it is accurate, public information about rights that already exist under federal and state law. We include it because DSPs are entitled to know about rights that apply to their work and because most existing DSP-facing software does not make that information easy to find.
If you disagree with this stance, DSPFY is not the right tool for you, and you should uninstall the app.
9. No warranty
DSPFY is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, FY Network Inc. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that DSPFY will be uninterrupted, error-free, or free of harmful components, or that AI-generated content will be accurate or suitable for any particular purpose.
10. Limitation of liability
To the fullest extent permitted by law, FY Network Inc. and its officers, directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of DSPFY. Our total liability for any claim arising from these Terms or your use of DSPFY will not exceed the amount you paid us for DSPFY, which, because DSPFY is free for DSPs, is zero dollars.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Intellectual property and model weights
DSPFY, including its name, branding, interface, code, prompts, regulatory content curation, and overall design, is the intellectual property of FY Network Inc.. You are granted a limited, non-exclusive, non-transferable, revocable license to install and use DSPFY for your personal professional purposes as a direct support professional.
The AI model weights bundled with DSPFY are based on open-source models (such as Meta's Llama, Google's Gemma, or Microsoft's Phi-3) licensed under their respective open-source terms. DSPFY may also ship fine-tuned adapter layers and model checkpoints developed by FY Network; these are covered by this license and may not be extracted, redistributed, or used outside of DSPFY for commercial purposes without written permission.
12. Third-party services
DSPFY may link to third-party services (Apple App Store, Google Play, the Rutgers College of Direct Support, Disability Rights New Jersey, state and federal regulatory websites, union resources, etc.). Those third parties are governed by their own terms and privacy policies. FY Network is not responsible for the availability, content, or behavior of third-party services.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will show a notice in the app the next time you open it so you can review what changed. Continued use of DSPFY after the Effective Date constitutes acceptance of the updated Terms.
14. Termination
You can terminate these Terms at any time by uninstalling DSPFY. We can terminate or suspend your access to DSPFY or future updates at any time if we believe you are violating these Terms, committing fraud, engaging in abusive behavior, or doing anything that creates legal or operational risk for us or our other users.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware and the federal laws of the United States. Any dispute arising from these Terms or your use of DSPFY will be resolved in a state or federal court located in Delaware, and both parties consent to the personal jurisdiction of those courts. You waive any objection to venue or inconvenient forum.
