1. Agreement to Terms

By accessing or using the website fynetwork.com or any services provided by FY Network Inc. ("FY Network," "we," "us," or "our"), including the DSPFY application, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Services

FY Network provides technology solutions for healthcare professionals, including the DSPFY application for Direct Support Professionals. Our services include Electronic Visit Verification (EVV), compliance tools, scheduling, documentation, and related communication features. We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.

3. SMS/Text Messaging Terms

By opting in to receive SMS or text messages from FY Network, you agree to the following terms:

  • Message frequency varies. You may receive service notifications, appointment reminders, account alerts, and other messages related to our services.
  • Message and data rates may apply. Standard messaging and data rates from your wireless carrier may apply to messages you send and receive. Check with your carrier for details about your plan.
  • Reply STOP to opt out. You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a confirmation message and will no longer receive SMS messages from us unless you opt in again.
  • Reply HELP for help. If you need assistance, reply HELP to any message or contact us at admin@fynetwork.com or +1 (973) 649-9368.
  • Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless carrier. FY Network and wireless carriers are not responsible for delayed or undelivered messages.

4. User Responsibilities

  • You must provide accurate and complete information when using our services.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair our services.
  • You agree not to attempt to gain unauthorized access to any part of our services, systems, or networks.

5. Intellectual Property

All content, features, and functionality of our website and services—including text, graphics, logos, trademarks, and software—are the exclusive property of FY Network Inc. or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

6. Limitation of Liability

To the fullest extent permitted by law, FY Network Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total liability for any claim arising from these terms or your use of our services shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim.

7. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located in New Jersey.

8. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the revised terms.
